Law: Sometimes the Law is Fun

Came across a fun random case in torts today while reading about consent.

 The case is Neal v. Neal  the cite is 873 P.2d 871 (Idaho 1994).

 The case is a wife suing her husband for battery.  The wife claims that when her and her husband had what was then consentual sex, he wasactually commitin battery against her because he failed to disclose to her that he was having an affair.  Her claim is that the “consent” she gave was obtained under terms of fraud because he kept important information from her in order to secure the consent.
